Consumer Rights, Delivery, Return and Cancellation Policy

If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

Through our website, you can benefit from online single payment or installment options with all types of credit cards. In online payments, the amount will be charged to your credit card at the end of your order.

The CONSUMER is subject to the provisions of the Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188), as well as other applicable legislation, regarding the sale and delivery of the purchased product.

Each purchased product shall be delivered to the person and/or organization at the address specified by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, the CONSUMER may terminate the contract.

If it becomes impossible to sell the purchased product, the SELLER must notify the buyer in writing within 3 days of learning of this situation. The total amount must be refunded to the CONSUMER within 14 days.

If the CONSUMER does not pay for the purchased product or cancels the payment in bank records, the SELLER’s obligation to deliver the product ceases.

After the product is delivered, if it is determined that the credit card used for payment was used unfairly by unauthorized persons and the product price is not paid to the SELLER by the relevant bank or financial institution, the CONSUMER must return the product subject to the contract to the SELLER within 3 days, with shipping costs covered by the SELLER.

If force majeure events beyond the SELLER’s control occur and the product cannot be delivered on time, the CONSUMER will be informed. The CONSUMER may request cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is removed. If the CONSUMER cancels the order and paid in cash, the fee will be refunded within 14 days. If paid by credit card, the refund will be made to the bank within 14 days, but it may take 2–3 weeks for the bank to transfer it to the CONSUMER’s account.

The CONSUMER must inspect the goods/services before accepting delivery and must not accept damaged or defective items (e.g., dented, broken, torn packaging) from the courier. Accepted goods/services are considered to be intact and in good condition. The CONSUMER is responsible for protecting the goods/services after delivery. If the right of withdrawal is to be exercised, the product must not be used.

In distance contracts related to the sale of goods, the CONSUMER has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery without any legal or criminal liability and without giving any reason. In service contracts, this period starts from the date of signing the contract. If it is agreed that the service will be performed before the 7-day period expires, the CONSUMER may exercise the right of withdrawal until the service begins.

If the CONSUMER exercises the right of withdrawal, the product must be returned to the SELLER via the contracted cargo company, MNG Cargo. If the return is sent via the contracted cargo company, the costs arising from the withdrawal right belong to the CONSUMER. If a different cargo company is used, the return shipping costs must be covered by the CONSUMER.

To exercise the right of withdrawal, the SELLER must be notified via the email address info@umaypharma.com within 7 days, and the product must not have been used in accordance with Article 15 of the Distance Contracts Regulation and Article 6 of the Distance Sales Contract signed electronically between the parties. Detailed return procedures under the right of withdrawal are also included in the Distance Sales Contract.

After the return request is approved via email by UMAY İLAÇ SAN ve TİC AŞ, the CONSUMER must return the product within 10 (ten) days from the date the withdrawal notice reaches the SELLER, via the contracted cargo company. If the product is not returned within this period, the withdrawal request becomes invalid. If the return request is not approved, the CONSUMER will be informed and, if the product has already been sent, it will be returned to the CONSUMER with payment on delivery.

If the campaign threshold amount falls below the required limit due to the use of the right of withdrawal, the discount benefited from within the campaign will be canceled.

Due to their nature, single-use products, copyable software and programs, and products that deteriorate quickly or are likely to expire cannot be returned. Unless otherwise agreed by the parties, the CONSUMER cannot exercise the right of withdrawal in the following contracts:

i. Contracts related to goods or services whose prices fluctuate depending on financial markets and are beyond the control of the seller or provider.
ii. Contracts related to goods prepared in line with the consumer’s requests or personal needs.
iii. Contracts related to the delivery of perishable goods or goods likely to expire.
iv. Contracts related to goods that are unsuitable for return due to health and hygiene reasons if their protective elements (packaging, seal, etc.) have been opened after delivery.
v. Contracts related to goods that are mixed with other products after delivery and cannot be separated by nature.
vi. Contracts related to books, digital content, and computer consumables provided in physical form if their protective elements have been opened after delivery.
vii. Contracts for the delivery of newspapers and periodicals, except those provided under subscription agreements.
viii. Personalized products with names or logos printed, and fountain pens with cartridges inserted or ink filled cannot be returned. Promotional or campaign products given as gifts must also be returned together with the main product.

For products to be returned under the “Right of Withdrawal,” they must be sent complete and undamaged with their original box, packaging, standard accessories, and original invoice. If the invoice is issued to a company, a return invoice must be included. Otherwise, the return cannot be completed.

Returned products must be packaged in a way that prevents damage during shipping and sent via our contracted cargo companies. Poorly packaged products that are damaged during shipment will not be accepted.

After checking that the product complies with return conditions, the refund will be made to your card. Depending on your bank, it may take a few days for the payment to reflect in your account. Refunds will be made in the same way as the payment. For installment payments, refunds will be processed in installments by the bank.
